These terms are an agreement between you and Marine Surveyors Pro ("we," "us") governing your use of the Marine Surveyors Pro website, mobile apps, and related services (together, the "Service"). By creating an account or using the Service you agree to these terms and to our Privacy Policy.
1. What the Service is — and is not
Marine Surveyors Pro is software: a professional tool that helps marine surveyors record inspections, organize photographs and data, and produce, share, and deliver survey reports. The Service is not a marine surveying firm, does not perform surveys, and does not provide professional, legal, insurance, or valuation advice. Every report produced with the Service is the professional work product of the surveyor who created it.
2. Professional responsibility
You remain fully responsible for your professional work. The Service organizes and formats what you record — it does not verify it. You are solely responsible for the accuracy, completeness, and professional adequacy of your surveys and reports, for meeting the standards of your accrediting organizations and applicable law, and for your obligations to your clients.
Features that use artificial intelligence (document import, form scanning, narrative drafting) produce drafts that can be wrong or incomplete. They are provided to save typing, not judgment. You must review and correct AI-assisted content before relying on it or delivering it to anyone; delivering unreviewed AI output is a misuse of the Service.
3. Eligibility and accounts
- The Service is for use by professionals and others aged 18 or older.
- Provide accurate account information and keep your credentials confidential — activity under your account is your responsibility.
- We may verify, suspend, or revoke accounts to protect the Service or its users (for example, accounts used abusively or fraudulently).
4. Your content
- You own your content — your surveys, reports, photographs, and records remain yours.
- You grant us only the limited rights needed to operate the Service: storing your content, syncing it between your devices, generating your reports, processing it through the features you invoke (such as AI import), and delivering it where you direct (such as emailing a report to your client or serving a share link you created).
- You are responsible for having the right to record and share the content you put into the Service, including personal information about vessel owners, buyers, insureds, and clients.
- Share links you create are viewable by anyone who has the link until they expire or you revoke them — distribute them as carefully as the documents they contain.
5. Acceptable use
Do not use the Service to break the law, to infringe others' rights, to store or distribute malicious code, to misrepresent surveys or fabricate records, or to probe, overload, or interfere with the Service's security or operation. Do not resell or provide the Service to third parties as your own offering, and do not attempt to extract other users' data.
6. Fees, billing, and cancellation
The first 14 days are free. A new account has every feature switched on for fourteen days, up to three surveys, and no payment details are required to start. Reports you produce during the trial print without a watermark. When the trial ends, the account becomes read-only: your surveys stay yours to read and print, and creating or editing new work resumes once the account is activated.
After the trial, the Service costs US$49.99 per surveyor per month, billed monthly in advance, plus any sales tax that applies where you are. There is no setup fee, no charge per report, and no limit on the number of surveys, reports, or photographs on an active account. A subscription covers one surveyor; each person using the Service needs their own account.
- Renewal — your subscription renews automatically each month on the same date until you cancel. We email a receipt for every payment.
- Payment — by credit card, debit card, or US bank transfer (ACH), handled by our payment processor, Stripe. We never receive or store your full card or bank account details.
- Cancelling — you can cancel yourself at any time from Account → Manage billing, or by emailing us. Cancellation takes effect at the end of the period you have already paid for: you keep full access until then, and you are not billed again.
- Refunds — we do not pro-rate a partial month. If something has gone wrong, write to support@marinesurveyorspro.com; we would rather put it right than argue over a month’s fee.
- After you cancel — the account becomes read-only, exactly as at the end of the trial. Your surveys, reports, and photographs remain yours to read and print for as long as the account exists, and subscribing again restores full access. Nothing is deleted because you stopped paying.
- Failed payments — if a payment fails, Stripe retries it over the following days and notifies you. If it ultimately fails, the account becomes read-only rather than being closed.
- Price changes — we will give at least 30 days’ notice by email before changing the price of an existing subscription, and you may cancel before it takes effect.
Prices shown on marinesurveyorspro.com are in US dollars. The price you are shown at checkout is the price you pay.
7. Availability, backups, and your records
We work to keep the Service available and your data safe, including cloud storage and routine backups, but the Service is provided "as is" and "as available" — no software service can promise uninterrupted availability or zero data loss. Marine survey reports are professional records: keep your own copies of delivered reports (printed, PDF, or exported) as part of your normal professional practice.
8. Disclaimers and limitation of liability
To the fullest extent permitted by law: the Service is provided without warranties of any kind, express or implied, including fitness for a particular purpose; we are not liable for the content, accuracy, or consequences of any survey or report produced with the Service; and we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim or one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Termination
Cancelling a subscription and deleting an account are different things. Cancelling stops the billing and leaves your records in place (section 6); deleting removes them. You can delete your account at any time (Account → Delete My Account) — export anything you want to keep first, since deletion is permanent. We may suspend or terminate accounts that violate these terms, with notice where practical. Sections of these terms that by their nature should survive (your ownership of your content, disclaimers, limitations of liability) survive termination.
10. Changes
We may update these terms as the Service evolves. If a change is material we will update this page and its effective date, and for significant changes we will make the update visible in the Service. Continued use after a change means the updated terms apply.
11. Governing law
These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Texas.
